Transportation has a number of specialist areas, each requiring a good technical understanding, knowledge of procedures and the particular legislative framework for effective claims resolution. We detail below our expertise and experience in each of these areas.
RAILWAYS
- David Martin was for five years (2000-2005) the account director for Railtrack (then Network Rail) on behalf of the nominated adjuster to the main property programme.
- This included managing the bordereau (for all above deductible claims including liability) for the Captive and working with the excess market and lead insurers.
- This period coincided with a number of high profile incidents including Ladbroke Grove, Hatfield, Selby and Potters Bar as well as severe storm claims including landslips and embankment failures. These were complicated by the uninsured issue of gauge corner cracking to the running rails which necessitated extensive re-railing around the UK.
- David Martin had a direct technical involvement in all the major claims including quantum, contractual, policy and legal aspects. He has in depth knowledge of the rail industry including CAHA, the Attribution Process and the Performance Regime.
- Mike Wagstaff is a self confessed railway buff with almost encyclopaedic knowledge of all things railway from junction layouts to the details of rolling stock components. He previously worked for St Paul a leading railway insurer. His knowledge has already proved invaluable on getting to the root of a number of rail industry claims.
- Tom Battell was a director of Miller Rail and has also been involved in a number of rail industry claims and investigations into corporate governance.
ROAD TRANSPORT
- Both Tom Battell and David Martin have dealt with substantial product liability claims in the automotive industry together with first party claims including those involving motor trade outlets.
- David Martin successfully investigated a large fraudulent fire claim involving stolen commercial vehicles and which included vat and finance fraud.
MARINE AND AVIATION
- We have handled various claims in these areas, including product liability, infrastructure losses and business interruption.
- Tom has handled claims for simulators, aircraft electrical systems and marine propulsion systems. David undertook a detailed analysis of cruise ship fuel performance.
TRANSIT
- We are experienced at handling transit and cargo claims particularly where there are complex financial and contractual issues, although not one of our specialist areas.
